Based on German tourist travel law
Furthermore, peculiarity, circumstances and local conditions of nature- and amusement holidays with adventure character are included.
1. Registration
On registration, the customer offers the tour operator a binding settlement of a travel contract. The registration can be made written (via booking form or internet), orally or by phone. The registration is valid for all participants listed on the registration form. The contract comes into being by accepting through the tour operator. There is no specified form necessary. By or immediately after conclusion of the contract the customer gets the booking confirmation from the tour operator. Regarding minors, the registration has to be signed by the parents or a legal guardian.
If the content of the confirmation differs from the content of the registration, this is considered a new offer of the tour operator and the tour operator is bound to it for 10 days. The contract becomes valid of this new basis if the customer declares his agreement within this time.
2. Payment
A deposit of 50% of the overall-price is due within 7 working days after receiving the booking confirmation. The final balance is due no later than 60 days prior to departure date. For bookings which are made less than 60 days prior to departure date, the whole amount is due on receiving the booking confirmation. The sending or handing over of the travel documents takes place after receiving the money. The overall-price as well as services included can be read in the individual travel descriptions. If payments are not received by due date, the customer is not entitled to the performance of travel services by Bienvenidos Honduras Reisen.
3. Number of minimum participants
Bienvenidos Honduras Reisen reserves the right to cancel a tour if the minimum number of participants is not reached. In this case we will inform you up to 30 days prior to the date of departure and we will refund all payments made.
4. Modifications of listed tours, Price increase
Changes to or deviations from individual travel arrangements (e.g. changes in flight schedules, changes in itinerary) are only permissible if they arise after conclusion of the contract and are made in good faith and do not affect the overall character of the journey. Possible warranty claims remain unaffected so far as the altered services are flawed. The tour operator is obliged to inform the customer about changes to or deviations from the services as soon as possible. If necessary, a changed booking or withdrawal free of charge is offered to the customer.
Bienvenidos Honduras Reisen reserves the right to increase the prices, after a contract has been concluded, in the following cases which Bienvenidos Honduras Reisen is not responsible for: A change in currency conversation rates; fare changes; official fees; taxes or other newly introduced or increased obligatory fees inclusive airport- and safety taxes.
A price increase, however, is only permissible, if there is a period of more than 4 month between conclusion of the contract and date of departure. If this is the case, the customer will be informed immediately, at the latest 3 weeks prior to departure. A later price increase is not permissible. If the price increase is more than 5 % of the original price of the journey, the customer has the right to withdraw from the journey within 10 days at no charge or to demand the participation in an alternative tour of equal value, if Bienvenidos Honduras Reisen is able to offer such a tour without additional costs for the customer.
5. Cancellation, Substitutes, Altered booking, No-show and Non-utilization of services
The customer can withdraw from the tour at any time prior to departure. You have also the right to name a substitute prior to departure. Bienvenidos Honduras Reisen may refuse the participation of a substitute if this person does not fulfil the special travel requirements or if public acts also of the holiday destination or orders of the authorities stand in the way of participation. If a substitute joins the contract, the customer as well as the substitute is jointly and severally liable for the price and arising excess costs towards Bienvenidos Honduras Reisen. If not agreed otherwise, alteration fees of €50 incur. The receipt of the oral or written statement at Bienvenidos Honduras Reisen is binding for the calculations of the time allowed. In any case of cancellation by the customer, a handling fee of €150 will be charged.
In case of withdrawal by the customer, Bienvenidos Honduras Reisen is entitled to the following payments:
- up to 90 days prior to departure 10% of the price, at least €150 handling fee per person
- from 90 until 60 days prior to departure date 25% of the price,
- from 59 until 30 days prior to departure date 50 % of the price,
- from 29 until 14 days prior to departure date 75 % of the price,
- from the 14th day prior to departure date 90% of the price,
- on the day of departure or in case of no-show 100 % of the price.
In the following cases, which Bienvenidos Honduras Reisen is not responsible for; Bienvenidos Honduras Reisen is entitled to full payment:
- No-show or delayed appearance at the beginning/at departure
- cancellation on the day of departure or for reasons, not within the responsibility of Bienvenidos Honduras Reisen or if the customer must be excluded from the departure or continuation of the tour. Possibly arising excess costs because of efforts to take the customer to his final destination are charged to the customer.
6. Unusual circumstances, Delay, Special costs
In case of Force Majeure the contract can be cancelled as well by Bienvenidos Honduras Reisen as by the customer. Force Majeur means unusual and unforeseeable circumstances beyond our control or the control of our suppliers, resulting in events that we could not have avoided even if all reasonable care had been taken.
If the contract is cancelled, Bienvenidos Honduras Reisen can demand an appropriate compensation for services already delivered and for services necessary to bring the tour to an end. In these cases Bienvenidos Honduras Reisen is obliged, to take the necessary measures, especially if the contract involves transportation. The excess costs for return transportation have to be borne by the parties half each.
All special costs as a result of or in connection with changes in the scheduled itinerary for reasons lying in the customer’s person (e.g., staying in hospital, early return) are charged to the customer.
7. Documents, Passport, Foreign exchange control regulations, Customs- and Health regulations
The tour operator takes responsibility to inform nationals of the countries where the journeys are offered about regulations regarding passport, visa and health as well as possible amendments prior to departure. Members of other countries get information at their consulate or embassy. Regarding the health- and vaccination regulations, we point out that these are guide lines only. Regarding prophylactic measures, consult your doctor or a specialist travel clinic at least two months in advance. Each participant is responsible for obeying the rules and regulations in the countries he/she travels to.
The tour operator is not liable for the punctual issuing of visas.
The obeying of all important regulations necessary for the performance of the journey are within the customer’s own responsibility.
8. Duty to cooperate
If the customer has reasons for complaint during the journey, these must be communicated immediately to the service provider. In addition, the customer is obliged to do everything possible to help to eliminate/correct the problem and limit the possible damage. Any claim for compensation must be received in writing by Bienvenidos Honduras Reisen not later than one month after the agreed date of the end of the journey. Once this period has expired, the customer can only assert a claim if it was not his or her fault not to comply with the time limit. The statute of limitations for possible compensation claims is one year after the agreed return journey. The limitation of a claim starts on the agreed date of the end of the journey. If the customer asserts a claim, the period of limitation is suspended until the day on which Bienvenidos Honduras Reisen rejects the claim in writing.
9. Observance of instructions
If a participant violates protective provisions or his /her behaviour puts other participants or the continuation of the tour at risk, the representatives of Bienvenidos Honduras Reisen have the right to exclude the participant from the tour without refunding
10. Liability
The offered tours in Honduras are nature - and adventure holidays which require an increased willingness to take risks by the customer. The customer is explicitly advised that there is an increased remaining risk in terms of getting injured or damaged because of bad healthcare and country-specific diseases as well as unfamiliar environmental, traffic and weather conditions, flora and fauna. The customer must be in good health and in a normal physical condition. This is especially applicable to hiking tours and tours in dugout canoes in the rain forests of Honduras, which have evidently expedition character. The customer’s ability to swim is required. The participants declare by giving their signature that they take part in these tours at their own risk.
Liability because of deliberate damage and gross negligence through Bienvenidos Honduras Reisen are untouched. As far as Bienvenidos Honduras Reisen employs the services of vicarious agents or third parties, Bienvenidos Honduras Reisen is only liable for careful selection and usual control. Bienvenidos Honduras Reisen assumes no liability especially for damage caused by unduly course conditions.
Contractual claim for damages
The contractual liability of the tour operator to pay for damages which are no bodily injuries, is limited to three times the tour price as far as these damages were not brought about either intentionally or grossly negligently by the tour operator. The limitation to three times the tour price is also valid if the tour operator is liable only because of faults attributable to a service provider.
Claims for damages in tort
For all claims for damages in tort demanded against the tour operator which are not due to intention or gross negligence, the liability for damage to property is limited to three times the tour price. This maximum liability applies per traveller and journey. Possible claims for damages in excess thereof in connection with luggage according to the Montreal Protocol shall remain unaffected of this limitation.
The tour operator is not liable for defaults, damage to person and property in connection with third party services (excursions, sports events, exhibitions, transportation from and to announced destinations), which are solely arranged as external services, if these services are clearly marked as external services not being part of the service provided by the tour operator.
The tour operator is liable
for services which comprise the customer’s transportation from the place of departure to the final destination, in-between transportation and lodging during the journey and
in so far if the tour operator’s violation of the duty to provide information, to provide explanations and of organisational duties causes damage to the customer.
The participation in sports events and other holiday activities is at your own risk. You should inspect sports equipment and vehicles before using them. In case of accidents which may occur on sports events and other holiday activities, the tour operator is only liable if he is to blame. We recommend the purchase of an accident insurance.
Damages on or delay of luggage and goods by air travel are to claim immediately on the spot, at the latest, however, within 7 days after the assessment of damages in case of luggage and 14 days in case of goods and in case of delay within 21 days. This has to be done by notification of a claim at the responsible airline.
11. Travel cancellation insurance
We strongly recommend the purchase of travel cancellation insurance as well as of international travel insurance. It is our pleasure to advise you of this matter.
12. Miscellaneous
The legal venue of claims against Bienvenidos Honduras Reisen is at the location of the tour operator. The invalidity of one or more of the stipulations of the contract does not affect the validity of the whole contract. Moreover, the parties oblige to find a regulation which is close to the original contract.
In case of dispute, the German text of the terms and conditions is legally binding.
